Terms of use

1. Purpose
These terms govern access to and use of NextConfirmAI (“the service”), published by NextDev Technologies, a company based in Marrakech, Morocco (“we”). By creating an account, you accept them.
2. Account
The service is intended for professionals. You are responsible for keeping your credentials confidential and for any activity carried out from your account. An account opens a store on NextConfirmAI; you may invite team members to it, under your responsibility.
3. The service
NextConfirmAI is a management tool for cash-on-delivery orders. It includes in particular:
The exact scope of features and integrations is the one described on the site at the time of use; we update it regularly.
- the order pipeline, the confirmation call queue and confirmation links;
- the preparation of WhatsApp messages, opened in your own app - we neither send nor receive messages on your behalf;
- carriers: Sendit via API, the others in manual mode;
- COD cash reconciliation, catalogue and stock.
4. Your obligations
By using the service, you agree to:
- comply with Moroccan law, in particular Law 09-08 on the protection of personal data;
- hold the right to process your customers’ data (name, phone, address) and inform them of how it is used;
- not send unsolicited messages nor use the service for fraud, harassment or unlawful content;
- not attempt to access another store’s data nor disrupt the operation of the service.
5. Pricing and payment
The service is free up to 50 orders per month. Beyond that, a paid plan is required: prices, in dirhams, are those displayed on the Pricing page at the time of subscription.
Plans are monthly, without commitment, payable by bank transfer or CashPlus. Orders beyond a plan’s quota are billed 1 MAD per order, with no forced upgrade.
In case of non-payment, we may suspend access after a reminder. Your data is retained during the suspension, under the conditions of the privacy policy.
6. Data
Data processing is described in our privacy policy, which forms part of these terms. For your customers’ data, you are the data controller and we act as processor, on your instructions.
7. Availability and support
We do our best to keep the service available at all times, with daily off-site backups. Interruptions for maintenance or incidents remain possible; we do not guarantee uninterrupted availability.
Support is provided by email, and by WhatsApp for the plans that include it, during business hours in Morocco.
8. Intellectual property
The service, its code, design and trademarks remain the property of NextDev Technologies. Your data (orders, customers, catalogue) remains yours: you grant us only the right to process it in order to provide the service.
9. Liability
The service is a management tool: we are not a party to the sales between you and your customers nor to your contracts with carriers, and we are not liable for their conduct (delivery, returns, payouts).
Our liability, on any ground, is limited to the amount you paid us during the three months preceding the event giving rise to the claim.
10. Termination
You can close your account at any time from the app or by email; export your data first (CSV). We may suspend or close an account in case of a serious breach of these terms, after notice except in urgent cases.
Data is deleted within 30 days of closure, in accordance with the privacy policy.
11. Changes
We may change these terms. Any material change is announced by email at least 15 days before it takes effect; continued use of the service constitutes acceptance.
12. Governing law
These terms are governed by Moroccan law. Failing an amicable settlement, the courts of Marrakech have jurisdiction.
